I. Conclusion of contract
1. the contract is concluded as soon as the rooms, spaces, areas or other services are ordered and confirmed, or, if a confirmation is no longer possible due to time constraints, provided.
2. services shall only be provided on the basis of these Hotel T&Cs. General terms and conditions of the customer are not recognized.
3. subletting or re-letting to a third party requires the written consent of the hotel.
4. if a third party has ordered for a customer, it shall be liable to the hotel as joint and several debtor with the customer. The hotel may require the customer or the third party to make a reasonable advance payment.
5. if the content of the reservation confirmation differs from the content of the registration, the differing content of the confirmation shall become binding for the guest and for the hotel if the guest does not exercise the right of withdrawal offered within 10 days.
6 The limitation period for all claims of the guest is 6 months.
II. Arrival and departure
1. unless otherwise agreed, rooms may be occupied from 3 p.m. on the day of arrival. The room must be returned by 11:00 a.m. on the day of departure at the latest. Thereafter, the hotel may charge 50% of the full lodging rate (list price) until 4:00 p.m. and 100% after 4:00 p.m. The customer is at liberty to prove that the hotel has suffered no damage or significantly less damage.
2 Reserved rooms that are not occupied by 6 p.m. on the day of arrival at the latest may be reallocated by the hotel and will be charged at 100% cancellation costs. This does not apply if a later arrival has been expressly agreed in writing.
III. Prices, services
1 The agreed price and the agreed services of the hotel are set out in the reservation confirmation. The prices include service charge and VAT. The customer is obliged to pay these prices of the hotel. This also applies to services and expenses to third parties initiated by the customer.
2. if the value added tax changes after conclusion of the contract, the agreed prices shall change accordingly.
3. if the period between conclusion of the contract and the event or room booking exceeds 4 months and the price generally charged by the hotel for such services increases, the hotel may increase the contractually agreed price appropriately, but by no more than 10%. Prices may also be changed by the hotel if the customer subsequently requests changes to the booked rooms, the hotel’s services or the length of stay and the hotel agrees.
Seminar and conference events
These General Terms and Conditions (GTC) apply to all contracts concluded with the Hotel Bayerischer Hof, provided they meet the characteristics of the GTC Act. Written conditions negotiated in individual cases can be replaced by this.
1.Organizer
The organizer is deemed to be the person who acts as the client vis-à-vis the Hotel Bayerischer Hof. If this person is not at the same time the actual organizer, the actual organizer and the person authorized by the latter to act as organizer vis-à-vis the Hotel Bayerischer Hof shall be liable as joint and several debtors.
2.Reservation / Reservation confirmation
Each reservation becomes effective and guaranteed only upon express and written confirmation by the Hotel Bayerischer Hof. Payment of advance payments included in the confirmation by the deadlines specified in the confirmation is another condition for the effectiveness of the reservation. Reservation agreements sent by the Hotel Bayerischer Hof must be confirmed in writing by the booker or organizer within a period of 14 days from receipt of the reservation agreement. The receipt of the written confirmation by the Hotel Bayerischer Hof is decisive for compliance with the deadline. In the event of failure to meet the deadline, the booking and all associated agreements shall automatically become invalid, and the Hotel Bayerischer Hof shall not be required to set a grace period or to give separate notice of termination of the booking.
3.Price guarantee
The prices indicated in the confirmation are valid for 5 months from the effectiveness of the reservation. After this period, prices may be subject to change by a maximum of 10% without notice: the prices valid on the day of the event will then apply. If the rate of the statutory value added tax changes after the conclusion of the contract, the hotel also reserves the right to make the corresponding price adjustment without prior notice.
4.Number of participants and couvert guarantee
The number of participants indicated by the organizer at the time of reservation is binding for both contracting parties. If the organizer can only give an approximate number of participants, deviations of up to 10% upwards or downwards from the number initially given are possible, but in this case the exact number of participants must be communicated no later than 5 working days before the event. Otherwise, the Hotel Bayerischer Hof does not guarantee that, in the event of an increase in the number of participants beyond this, the service can be provided in an orderly and agreed manner. In this case, billing is otherwise based on the actual number of participants. In the event of a shortfall in the agreed number of participants, invoicing shall be based on the number of participants stated at the time of reservation or notified to the Hotel Bayerischer Hof no later than 5 working days prior to the event; in all other respects, the regulations for cancellation pursuant to Section 7 below shall apply.
5.Revocation of events
If the Hotel Bayerischer Hof has reasonable grounds to believe that the guest or the event threatens to jeopardize the smooth operation of the business, the safety or the reputation of the house, as well as in the case of force majeure (e.g. war ,fire, strike, etc.), the Hotel Bayerischer Hof may cancel any event or booking without being obliged to pay damages. The Hotel Bayerischer Hof may proceed in accordance with the provisions for cancellation set forth in Section 7 below and may, among other things, also charge the applicable cancellation fees. In the case of political or ideological/religious events or if the organizer is a political or ideological/religious association or represents such an association, but this is knowingly concealed when booking or concluding the contract, the hotel is entitled to terminate the contract extraordinarily at any time and to demand cancellation fees in accordance with Item 7 below.
6.Decoration material, own equipment
The attachment of decorative material or other objects by the booker or organizer or participant is not permitted without the express consent of the hotel. The organizer is liable for damages to the equipment or inventory caused during set-up and dismantling and/or during the event, even without proof of fault.
The organizer is not allowed to bring own food and beverages to the events. In special cases ( e.g. national specialties ) a separate written agreement can be made about this with the Hotel Bayerischer Hof. In this case, service charges and corkage fees to be agreed separately will be charged.
7.Cancellations
For events up to 20 rooms per day
In case of cancellation of bookings or events by the organizer or in case of non-utilization of the services offered by Hotel Bayerischer Hof, the contractual services ordered or reserved, not accepted by the booker or the organizer, but offered by the hotel (in particular for the lodging of the guests, the rent for conferences and function rooms and the catering) will be charged by Hotel Bayerischer Hof to the organizer at the following flat rates. The basis for calculation is the rooms confirmed and reserved in the contract.
For seminars from 20 rooms per day and more
8.GEMA
All music events must be registered with GEMA in advance by the booker or organizer. The fees of GEMA shall be borne by the organizer. Hotel Bayerischer Hof shall be indemnified by the organizer with regard to any claims of GEMA arising from unauthorized use of the rights of GEMA or third parties, e.g. due to non-registration by the organizer.
9.Liability
The organizer is liable for damages or loss of facilities or inventory caused by the participants during the event, without proof of fault. The bringing in of objects such as exhibits, decoration material, demonstration equipment or other technical equipment etc. is exclusively at the risk of the booker or the organizer and requires prior agreement with the hotel. Fire and commercial police regulations must be observed. Valuable items must be insured by the booker or organizer at his own expense against damage and loss, the Hotel Bayerischer Hof assumes no liability whatsoever, this is excluded. All items must be removed from the rooms and the hotel by the organizer no later than 3 hours after the event. The Hotel Bayerischer Hof shall not be liable for any damage to or loss of other items brought into the hotel or deposited in the hotel parking lot.
